Terms and Conditions of Use

1. Who provides the service

Publica Smart is a service provided by Alejandro Vidal, trading as Avvedit, with Spanish tax ID (NIF) Y6366165D and registered address at Calle de Pablo Lafargue 40, 28017 Madrid (Spain). You can reach us at contacto@publicasmart.com. By using the app, you accept these terms and our privacy policy.

2. What Publica Smart is

Publica Smart is a tool that, from the photos and details of a property you upload, automatically generates (with the help of artificial intelligence) a description, a PDF, an image for social media, and a video, and lets you publish them directly to the networks you connect (Instagram, Pinterest, YouTube, TikTok, LinkedIn).

3. Registration and account

To use Publica Smart you need to create an account with a valid email and be of legal age or otherwise have the legal capacity to contract. You're responsible for keeping your password secret and for all activity that happens on your account.

Access to your account is limited to a maximum number of devices with an active session at once: 2 on the Free plan, 3 on the Pro plan, 5 on the Max plan. If you reach that limit, you can log out of one from My Account → Connected Devices to free up a slot.

5. Right of withdrawal (consumer users in the European Union)

If you subscribe to the Pro or Max plan as a consumer within the European Union, you have 14 calendar days from subscribing to withdraw without needing to give a reason. However, Publica Smart is a digital service delivered immediately — by activating the plan and starting to use it, you expressly agree that performance begin immediately and acknowledge that, once the service has been fully performed, you lose your right of withdrawal (in accordance with article 103.a of Spanish Royal Legislative Decree 1/2007, which transposes article 16.m of EU Directive 2011/83/EU). If you haven't used the service yet, you can withdraw by writing to contacto@publicasmart.com within that 14-day period.

7. Publishing to third-party social networks

If you connect Instagram, Pinterest, YouTube, TikTok, LinkedIn, Facebook, or X, publishing happens through those platforms' official APIs (directly or via Upload Post), always with your explicit authorization. You're responsible for complying with each social network's terms of use; Publica Smart doesn't control and isn't responsible for the policies, changes, or suspensions those platforms apply to your account.

8. Acceptable use

You may not use Publica Smart to publish illegal, fraudulent, discriminatory content, or content that infringes third-party rights. We may suspend accounts that violate this.

9. Service availability

We make our best effort to keep the service available, but we don't guarantee uninterrupted availability. There may be maintenance or changes that temporarily affect it.

10. Limitation of liability

To the extent permitted by law, Publica Smart isn't liable for indirect damages, or loss of business or data arising from use of the service, beyond the amount you've paid in the last 12 months. Nothing in these terms limits the rights the law grants consumers on a mandatory basis.

11. Changes to these terms

We may update these terms; significant changes will be announced with reasonable advance notice. Continuing to use the service after a change implies acceptance of it.

12. Governing law, jurisdiction, and dispute resolution

These terms are governed by Spanish law. If you're a consumer, you can bring any claim before the courts of your place of residence, in accordance with European consumer protection rules. The European Commission also offers an online dispute resolution platform.
